Abstract

The plasma plantation partnership scheme is one of the Indonesian government's strategies to improve farmers' welfare and support the revitalization of the palm oil plantation sector. In this model, cooperatives act as partners representing the interests of farmers, while the core company is responsible for financing, technical assistance, and plantation development. However, the implementation of the partnership agreement between Koperasi Unit Desa (KUD) Al Barokah and PT. Tani Subur Makmur in Sungai Guntung Village, Indragiri Hulu Regency, did not proceed as expected. PT. Tani Subur Makmur was proven to have failed in fulfilling its obligation to develop the plantation as stated in the agreement, which led to a civil dispute that caused harm to the cooperative and its members. This study aims to analyze the legal implementation of the partnership agreement and identify the forms of breach of contract committed by the company. It adopts a juridical-empirical approach, utilizing primary data obtained through interviews with the cooperative, its members, and the company, as well as secondary data from literature studies and court rulings. The findings indicate that PT. Tani Subur Makmur was declared in breach of contract by the Rengat District Court through Decision Number 23/Pdt.G/2018/PN.Rgt, which was upheld by the High Court of Pekanbaru and the Supreme Court of the Republic of Indonesia through cassation Decision Number 1388 K/Pdt/2020, which has obtained permanent legal force (inkracht van gewijsde). This decision provides a legal foundation for the cooperative to demand fulfillment of the agreement and the rights of its members through judicial execution. The conclusion of this research affirms that legal protection for cooperatives must be continuously strengthened so that the plasma partnership model operates fairly, transparently, and sustainably to improve farmers' welfare in accordance with national development goals in the plantation sector.
