Abstract
Law Number 35 of 2014 concerning Child Protection represents the state’s commitment to guaranteeing, protecting, and fulfilling children’s rights as part of human rights. In Pekanbaru City, various violations of children’s rights are still found, such as physical violence, psychological abuse, and neglect, which indicate a gap between legal norms and their implementation in practice. Therefore, the implementation of Law Number 35 of 2014 needs to be examined in depth from a human rights perspective in order to assess the extent to which child protection has been effectively carried out by the local government and related parties. Based on this background, the formulation of the research problems in this study is: how is the implementation of Law Number 35 of 2014 concerning Child Protection from a human rights perspective in Pekanbaru City, and what are the challenges in the application of child protection in Pekanbaru City. The formulation of these problems aims to identify the forms of child protection implementation and to examine their conformity with human rights principles. The research method used in this study is an empirical juridical research method with a descriptive qualitative approach. The data were obtained through field research using data collection techniques in the form of questionnaires, interviews, and documentation studies. The respondents in this study included child victims of violence as well as university students as a comparison group in understanding perceptions of child protection in Pekanbaru City. The collected data were analyzed qualitatively to obtain a comprehensive overview of the implementation of the law. The results of the study indicate that the implementation of Law Number 35 of 2014 in Pekanbaru City has been carried out, but has not yet been optimal in ensuring the comprehensive fulfillment of children’s rights. There are still obstacles such as the lack of legal socialization, limited facilities and infrastructure, and low public awareness of the importance of protecting children’s rights. Therefore, it is necessary to enhance the role of local government, law enforcement officials, and the community in strengthening child protection based on a human rights perspective in Pekanbaru City.
