Abstract
The circulation of skincare products with exaggerated claims (overclaim) in Pekanbaru City reveals a gap between the regulations prohibiting misleading claims and the actual practices in the field. This phenomenon raises questions regarding the effectiveness of the Indonesian Food and Drug Authority (BPOM) in protecting consumers from misleading information, particularly concerning product safety, efficacy, and composition. The growth of trade through digital platforms, easy access via resellers, and low compliance among some skincare sellers further exacerbate the risks of overclaim, potentially causing both economic and health losses to consumers. This study aims to comprehensively analyze BPOM’s role in protecting consumers from overclaim practices in skincare products in Pekanbaru City and to identify challenges faced in pre-market and post-market supervision. The study is an empirical legal research with a statute approach and descriptive-analytical nature. Primary data were obtained through in-depth interviews with 22 respondents, including BPOM officials, pharmacists, skincare sellers, and consumers, selected using purposive sampling. In addition, legal documents and regulations related to cosmetics were analyzed to strengthen the theoretical and regulatory foundations of the study. The results indicate that BPOM Pekanbaru has conducted pre-market supervision through document and product composition verification, as well as postmarket supervision through monitoring advertisements and administrative enforcement. However, these supervisions have not been fully effective. Many skincare products with exaggerated claims are still circulated, especially via digital platforms and resellers, due to limited personnel, predominantly administrative oversight, and low seller compliance. Therefore, although BPOM plays a formal and important role, its practical effectiveness remains limited, allowing overclaim practices to persist.
