Abstract

his thesis examines the Implementation of the Function of the Village Consultative Body in Forming Village Regulations in Mahato, Rokan Hulu Regency Based on Law Number 6 of 2014. The main problem in this study is How is the Implementation of the Function of the Village Consultative Body in Forming Village Regulations in Mahato Village, Rokan Hulu Regency Based on Law Number 6 of 2014 and What are the Obstacles of the Village Consultative Body in Forming Village Regulations in Mahato Village, Rokan Hulu Regency. This study uses an empirical research method, namely a legal research method that functions to see the law in a real sense and examine how the law works in the community environment. From the results of the study it can be concluded that, 1) Based on the results of the study, the implementation of the function of the Village Consultative Body (BPD) in Mahato Village has in principle followed the provisions stipulated in Article 55 of Law Number 6 of 2014 concerning Villages, where the BPD has a role in accommodating and channeling community aspirations, discussing and agreeing on draft village regulations with the village head. However, in reality the implementation has not reached an optimal level. Despite formal procedures, the involvement of the Village Consultative Body (BPD) in the village legislative process tends to be ceremonial or merely a formality, without any substantive analysis or in-depth study of the village regulations being discussed. This situation is exacerbated by the limited human resource capacity of BPD members, both in terms of knowledge of village law and public policy analysis skills. Furthermore, intensive coordination with the village government, which should be carried out intensively, is not optimal, resulting in ineffective communication and synergy in the drafting of village regulations. The low level of active community participation in the process of formulating village regulations also reduces the quality of legislative outcomes at the village level. 2) The obstacles faced by the BPD in carrying out its functions include limited human resources, both in terms of quantity and quality, a lack of technical assistance and ongoing development from the local government, and the dominance of the village head in the legislative process, which makes it difficult for the BPD to play a balanced oversight role. Furthermore, the low level of public participation in the discussion of village regulations means that the legislative process does not reflect the needs and aspirations of the community as a whole. These obstacles have resulted in the ineffective implementation of the principle of checks and balances at the village level. Therefore, strategic efforts are needed to address this, including providing ongoing training and capacity building for BPD members, building closer synergy with the village government at every stage of village regulation development, and encouraging community participation through public consultation forums, village deliberations, or other inclusive and transparent mechanisms.
