Abstract

The misuse of visitor stay visas beyond the allowed time (overstay) by foreign nationals has become a significant issue in Indonesia, including in the Pekanbaru region. Overstaying can cause various problems, both legally, socially, and in terms of national security. The Immigration Office, as the authority responsible for monitoring and enforcing stay permit regulations, plays a crucial role in the prevention and handling of overstay cases. Although there are regulations in place regarding visitor stay visas, the enforcement of surveillance on the ground still faces various challenges, such as a lack of coordination between relevant agencies, limited resources, and low awareness among foreign nationals regarding their administrative obligations. The research questions in this study are: How does the Pekanbaru Immigration Office play a role in addressing the abuse of visit stay permits that exceed the validity period (overstay) by foreign nationals? What are the ideal regulations concerning stay permits for foreign nationals? And what are the challenges faced by the Pekanbaru Immigration Office in addressing the overstay issues among foreign nationals? This research will use a sociological legal or empirical juridical approach. Given the nature of the research, it is categorized as observational research, involving interviews as the primary method for data collection. The findings indicate that the Pekanbaru Immigration Office plays a crucial role in supervising the stay permits of foreign nationals, despite facing several challenges, such as limited human resources and coordination issues with the countries of origin of the foreign nationals. In terms of ideal visa regulation, the implementation of an electronic visa system and enhanced supervision through technologies such as biometrics and artificial intelligence (AI) are recommended solutions. However, significant challenges remain in enforcing strict sanctions against violations and the difficulty of repatriating foreign nationals who have overstayed. The study also suggests the need for more intensive socialization regarding immigration regulations to reduce visa violations by foreign nationals.
