Abstract

This research aims to analyze the legal implications of Constitutional Court Decision No. 62/PUU-XXII/2024 on the implementation of democracy and the party system in Indonesia, particularly following the abolition of the presidential threshold. A normative-juridical approach with descriptive-analytical methods was employed, relying on primary legal materials (MK decisions, the 1945 Constitution, Election Law), secondary sources (journals, books, articles), and tertiary sources (dictionaries, encyclopedias). Data were analyzed qualitatively using a combination of deductive and inductive reasoning. Findings indicate that the removal of the presidential threshold strengthens political participation, inclusive electoral competition, and democratic legitimacy rooted in popular sovereignty. However, it also poses challenges—including vote fragmentation, coalition complexity, and pressures on governability. Institutionally, the ruling encourages internal party democratization, merit-based cadre recruitment, and enhanced roles for independent bodies such as the KPU and Bawaslu. To balance openness with stability, systemic reforms are recommended: a proportional parliamentary threshold (2–3%), a two-round presidential election system, and intensified civic education to improve voter political literacy.
