Abstract

Indonesia adheres to the principle of decentralization, granting autonomous authority to regional governments. The governor's authority to issue a Governor Regulation is part of this regional autonomy. In architecture, Law Number 6 of 2017 stipulates that architectural license are issued by provincial governments, thereby necessitating governor regulations as a legal basis. This research examines the juridical aspects of the Governor of Riau’s authority in issuing governor regulation on architectural license, ensuing conformity with the legal hierarchy and legitimacy in promoting professional, high-quality, and sustainable architectural development. The main problem in this research are: how the governor’s authority in issuing governor regulation on architectural license under Indonesian legal system; and how the urgency of issuing a gubernatorial regulation on architectural license in Riau Province. This research was conducted using normative legal research method, namely library legal research through books, laws and regulations, and relevant literature. Based on the research, the results obtained that: 1. The Governor is authorized to issue a governor regulation on architectural license through two legal bases: attribution from Law Number 23 of 2014 on Regional Government, granting autonomy in public works and spatial planning, and delegation from Law Number 6 of 2017 in conjunction with Government Regulation Number 15 of 2021, which assigns licensing authority to provincial governments; 2. The establishment a Governor Regulation in Riau is urgent to ensure legal certainty, professional standards, and construtction quality. Without regulation, architectural practice risks irresponsibility, as shown by construction failures in Riau caused by weak architectural planning standards.
