Abstract
The negative impact of cyberporn is deeply concerning, particularly regarding the development of young people and children, as it severely damages their mental growth. The internet and modern technology today offer many conveniences to human activities in this modern era. However, some users exploit the internet to access content containing elements of cyberporn. Acts of cyberporn include activities such as producing with the intent to distribute through computer systems, offering via computer systems, distributing or transmitting through computer systems, accessing computer systems, and possessing such content within computer systems or digital storage media. This type of research falls under the category of empirical/sociological legal research, conducted by observing and investigating regulations as implemented in the field. This legal investigation is based on primary data. Primary data refers to data obtained directly from the Pekanbaru City Police Department, which serves as the main source, through field surveys or direct observation to collect the most crucial data. The conclusions that can be drawn from the results of this research are: First, the implementation of law enforcement at the investigation stage against the criminal act of cyberporn in the jurisdiction of the Pekanbaru City Police has been carried out in accordance with the applicable legal procedures, especially based on the provisions of Law No. 19 of 2016 on Electronic Information and Transactions (ITE) and Law No. 44 of 2008 on Pornography. Investigators at the Pekanbaru City Police have followed investigation stages, including receiving reports, conducting preliminary investigations, collecting electronic evidence, summoning witnesses and experts, as well as coordinating with related agencies such as the Ministry of Communication and Information (Kominfo) and the Prosecutor’s Office. Second, there are still significant and complex obstacles in the implementation of law enforcement at the investigation stage against the criminal act of cyberporn in the jurisdiction of the Pekanbaru City Police, covering juridical, technical, institutional, socio-cultural, and psychological aspects. Juridical obstacles arise from unclear and overlapping regulations governing digital pornography. Technical challenges include the limited availability of digital forensic tools and a lack of human resources skilled in information technology. Institutionally, weak coordination between agencies and the absence of a standardized national guideline result in non-uniform investigative processes across different jurisdictions.
