Abstract

Law enforcement is a fundamental aspect in ensuring justice and legal certainty in Indonesia as a state based on law. One of the pressing issues is the criminal act of embezzlement in office, which has shown an increasing trend in the jurisdiction of the Pekanbaru City Police. Problems arise when, during the investigation process—particularly during the suspect’s examination—the right to legal assistance is not always fulfilled, as observed in the case of defendant SA in Decision Number 600/Pid.B/2021/PN Pbr. This raises questions regarding the effectiveness and conformity of law enforcement with the principle of due process of law as stipulated in the Indonesian Criminal Procedure Code (KUHAP). The research problems addressed in this study include: how law enforcement is carried out during the investigation stage against perpetrators of embezzlement in office within the jurisdiction of the Pekanbaru City Police, and what obstacles are encountered in its implementation. This study uses an empirical legal research method with a qualitative approach, employing data collection techniques such as interviews with investigators and document analysis. The findings reveal that although the investigators at the Pekanbaru City Police generally follow formal procedures, there are still violations of suspects’ rights, especially regarding their right to legal counsel at the early stages of investigation. The main obstacles to effective law enforcement include limited human resources, lack of understanding of procedural law, and suboptimal internal supervision
