Abstract

Consumer protection is a vital legal aspect in Indonesia, as regulated in Law Number 8 of 1999 concerning Consumer Protection. The issue of frame damage in eSAF-type motorcycles produced by PT. Astra Honda Motor (AHM) has raised concerns regarding the fulfillment of consumers' rights to safety and security. This study is motivated by numerous complaints from consumers about rusting and breaking of eSAF frames, raising legal questions about business actors’ responsibilities under Articles of the Consumer Protection Law. This research addresses two main problems: What is the legal protection provided to consumers of PT. Astra Honda Motor motorcycles experiencing frame damage under Law Number 8 of 1999 and what legal responsibilities must PT. Astra Honda Motor fulfill regarding such damage? The method used is empirical legal research with a descriptive approach. Data were collected through questionnaires and interviews involving 30 consumers and company representatives. Data were analyzed using the interactive model of Miles and Huberman. The results show that consumers are entitled to legal protection, including compensation and product guarantees, as stipulated of the law. PT. Astra Honda Motor holds legal responsibility based on the principle of strict liability to provide repair, replacement, or compensation as mandated by Article 19. However, there remain challenges in transparency and post-sale service mechanisms that must be addressed.
