Abstract

The country's development is hampered by the increasing problem of traffic violations that cause death. The increasing incidents of traffic violations that cause death are believed to be influenced by various causes, such as human factors that are negligent or deliberate, vehicles that are not roadworthy for long- distance travel, and the rampant methods of traffic violations that cause death. The increasing cases of traffic violations that cause death not only cause financial losses, but also threaten the safety of other road users, harm the country's economy, and violate human rights. Based on the background above, the formulation of the problem in this study is: First, how is the implementation of law enforcement against traffic violations that cause death at the Rokan Hilir Police? Second, what are the obstacles in the implementation of law enforcement against traffic violations that cause death in the Rokan Hilir Police Traffic Unit area. The research conducted is descriptive legal research which means describing and describing the results of data problems that occur in the field by combining legal materials which are secondary data and primary data obtained. The type of research used by the author is a type of research that has an empirical form because the author obtains data and information obtained directly by meeting directly with respondents to conduct interviews so that it is easier for the author to obtain concrete data and information. The author conducted research by directly visiting the research location at the Rokan Hilir Police located at Jalan Lintas Riau-Sumut, Kel. Banjar XII, Riau Province. The results of this study show that law enforcement against traffic violators causing death in the Rokan Hilir Police Traffic Unit area can be carried out optimally by referring to applicable laws and regulations. Action against perpetrators must refer to Article 310 paragraph (4) of Law Number 22 of 2009 concerning Traffic and Road Transportation and Article 359 of the Criminal Code (KUHP) which regulates criminal acts due to negligence resulting in the loss of a person's life. The obstacles faced by law enforcement in handling traffic violations causing death in the Rokan Hilir Police Traffic Unit area include four main factors, namely: legal substance factors that do not fully support the effectiveness of enforcement, limitations in law enforcement factors and low human resources from the police, low public awareness and compliance with traffic regulations, and minimal supporting facilities and infrastructure.
