Abstract
From the perspective of international humanitarian law, the violence that occurred in Palestine constitutes a serious violation of the basic principles as stipulated in Article 3 of the Geneva Conventions and Additional Protocol I. Both of these instruments expressly stipulate that each party to an armed conflict must treat persons not involved in hostilities with full respect and protection. Israel's actions against Palestine have become a global concern, involving international law and international law enforcement, especially the International Criminal Court (ICC). The situation is increasingly complex with the increasing attacks carried out by Israeli militant groups targeting Palestinian territories and communities, especially women and children. This makes the opportunity for peace difficult to be realized by international parties, especially the International Criminal Court (ICC). The problem of this study is regarding the Form of Gross Human Rights Violations in the Armed Conflict in Israel and Palestine based on the International Criminal Court (ICC) and the Role of the International Criminal Court (ICC) in Gross Human Rights Violations in the Armed Conflict in Israel and Palestine. This study uses a normative legal research method, where the author conducts a literature study by examining primary, secondary, and tertiary data in the form of Legislation covered by the International Criminal Court (ICC), reading materials, books, literature, expert opinions related to the main problem of this study, dictionaries, mass media, and the internet. Data analysis, namely after the author obtains the necessary data from primary, secondary, and tertiary legal materials, then the data is summarized and arranged in the form of systematic sentences. From the results of this study, it can be concluded that the armed conflict between Israel and Palestine has caused various forms of gross human rights violations as regulated in humanitarian law and basic international principles. This study also discusses the role of the International Criminal Court (ICC) in handling these violations in enforcing international law against Israel is still limited due to political factors and the legal status of Palestine. resolving this conflict requires stronger international cooperation, both through legal mechanisms and global diplomacy, in order to uphold justice for victims and encourage the creation of sustainable peace.
