Abstract

Legal protection for investors constitutes a fundamental element in creating a conducive, sustainable, and competitive investment climate in Indonesia. The existence of clear and consistent legal guarantees not only serves to protect investors’ interests but also functions as a strategic instrument to support national economic growth. This article aims to analyze the forms of legal protection provided to investors in investment activities in Indonesia, covering both domestic and foreign investors, as well as to examine the challenges encountered in their practical implementation. This study employs a normative juridical approach by reviewing laws and regulations governing investment activities, particularly Law Number 25 of 2007 on Investment, supported by an analysis of relevant national legal journals and academic literature. The findings indicate that, from a normative perspective, the Indonesian legal system has established a legal framework that encompasses principles of equal treatment, legal certainty, protection of property rights, and mechanisms for investment dispute resolution. In addition, the government has undertaken various efforts to strengthen the investment climate through regulatory reforms and the simplification of licensing procedures. Nevertheless, in practice, the implementation of legal protection for investors has not yet been fully effective. Several obstacles, including bureaucratic complexity, regulatory inconsistency, and weaknesses in law enforcement, continue to pose significant challenges and may undermine investor confidence. These issues demonstrate a gap between normative legal provisions and their application in the field. Therefore, it is necessary to enhance the effectiveness of legal implementation, harmonize investment-related regulations, and improve the capacity and integrity of supervisory institutions. Such measures are essential to ensure effective legal protection for investors and to provide sustainable legal certainty, thereby fostering a more reliable and attractive investment environment in Indonesia
