Abstract

This research aims to analyze the implementation of constitutional duties of the General Election Commission (KPU) in organizing the 2024 Simultaneous Regional Head Elections in Siak Regency, focusing on KPU's implementation of duties in handling Bawaslu's recommendations and KPU's follow-up in implementing Constitutional Court Decision Number 73/PHPU.BUP-XXIII/2025. The research uses empirical juridical method with descriptive nature, collecting data through interviews with the Chairman of KPU, KPU Members, Chairman of Bawaslu, and Bawaslu Members of Siak Regency as well as analysis of related legal documents. The results show that KPU of Siak Regency has followed up on 16 violation reports/findings from Bawaslu consisting of 4 administrative reports, 8 criminal reports, and 4 code of ethics reports through 6 systematic stages namely recommendation receipt, initial assessment, internal and external consultation, follow-up determination, implementation and monitoring, and reporting and evaluation, successfully imposing disciplinary sanctions on KPPS officers at TPS 49 Perawang Village Tualang District and TPS 7 Sungai Mempura Village Mempura District, although there were obstacles in enforcing sanctions in 2 other cases because the KPPS duty period had ended on December 8, 2024. In implementing the Constitutional Court Decision, KPU conducted Re-voting (PSU) on March 22, 2025 in 3 locations with a total of 1,011 voters namely TPS 3 Jayapura Village Bungaraya District (494 voters), TPS 3 Buantan Besar Village Siak District (453 voters), and Special Location TPS at Tengku Rafi'an Regional Hospital (64 voters), where the establishment of Special Location TPS is a progressive legal breakthrough that becomes a new precedent or jurisprudence in Indonesian elections to protect the constitutional rights of 125 people who previously could not exercise their voting rights, with PSU results combined with non-cancelled votes establishing Afni-Syamsurizal as the elected Regent and Vice Regent of Siak for the 2025-2030 period through an Open Plenary Meeting on May 7, 2025. The research concludes that KPU of Siak Regency has carried out its constitutional duties in accordance with Article 18 letter i of Law No. 7/2017 on Elections and Article 157 paragraph (10) of Law No. 10/2016 on the Election of Governors, Regents, and Mayors, by applying the collegial collective principle in decision making and coordinating with Bawaslu, Regional Government, Police, Military, and Prosecutor's Office, but there is still room for improvement especially in the mechanism of enforcing sanctions against ad hoc officers and the need for more comprehensive arrangements regarding the provision of voting facilities for voters in special conditions.
