Abstract
Currently, Crimes that often occur in society are manipulation and fabrication of digital evidence. The use of digital forensics to spread disinformation or hoaxes can be done by anyone. These crimes can occur due to several main factors related to the development of digital technology, regulations, the political situation, and understanding of the internet. Cybercrime can also occur due to a combination of technology, regulations, the political situation, and understanding of the internet. Cybercrime can also occur due to a combination of technologycal advancements, lack of digital literacy, economic motives, regulatory weaknesses, and security vulnerabilities in digital systems. Therefore, preventing cybercrime requires a collaborative approach, including enhancing digital literacy, strengthening regulations, improving ITE security systems, and fostering international cooperation in enforcing digital law. Based on the background of this thesis, the main focus of the researcher is to examine and analyze the criminal provisions in OTE cases at the Riau Regional Police Headquarters and to analyze Ufed Cellebrite after the enactment of the ITE Law. To understanding the problem formulation, this study will collect data using surveys or direct field research through interviews. The purpose of this data collection is to gain a clear understanding of the factors that cause ITE crimes and the efforts made to prevent them. From the results of the author’s research, in handling casses of crime in the field of Information and Electronic Transaction (ITE), digital evidence has legal standing as evidence even though it is not explicitly mentioned in the Criminal Procedure Code, with further provisions in the ITE Law that recognize the validity of digital evidence such as electronic information, electronic documents, hardware, and software. The success of digital forensic analysis requires strict procedures in the collection and analysis of deleted data, as well as the recovery of metadata, with the aim of maintaining the authenticity of the evidence. To optimize the use of digital forensic tools, such as Ufed Cellebrite, at the Riau Regional Police Headquarters, it is necessary to improve human resource competencies through training and certification, optimize the use of devices by utilizing advanced features, and collaborate with oyher institutions. The implementation of procedures in accordance with international standards and the development of internal policies are also important factors in ensuring processes that are legally compliant and effective in uncovering digital crimes.
