Abstract

This research is motivated by the lack of effective efforts and regulations regarding the rules of child exploitation which are still weak so that there are still many cases of exploitation that often occur so that the police, especially in the field of PPA Polresta Padang and also the office of the protection of women and children in the city of Padang in tackling the crime of child exploitation is less effective. So that an increase in cases of child exploitation occurred from 2022 - 2024, which is around 350 where the increase occurred after the pandemic occurred. Therefore, this paper focuses on how criminal liability is applied to perpetrators of child exploitation crimes as well as knowing internally what are the obstacles in tackling child exploitation crimes in the city of Padang. By considering that the importance of children is not only about a sufficient life, but more than the role of the government in sustaining a guaranteed life for children who are sometimes in the dark still less stable and vulnerable to child exploitation. Judging from the point of view of the method used in this research is the type of sociological legal research, what is meant by this sociological research is a research method to see the effects of the enactment of positive law in society, because in this research the author conducts research directly in the place under study, while in terms of its nature, it is descriptive, which is a research method carried out by describing the efforts made by the city government of Padang in tackling child exploitation and also This research was conducted using a qualitative approach using descriptive analytical methods and data collection techniques with interviews, observations and document reviews. Based on the results of the research, it can be concluded that the author found that there are still many children under the age of 18 who are on the streets, tourist attractions and stations who are often found begging, busking and also scavenging, whose average age is still relatively young, namely under 21 years. This is also true by the police in tackling the crime of child exploitation, as if it has become commonplace when several children walk in front of the police carrying their merchandise and this shows that it is not only the actions of the police that are needed but also the role of the community and the instincts of everyone who sees them.
