Abstract

The purpose of giving dispensation to applicants who are pregnant is basically to protect the interests of the child as stated in Article 2 Perma No. 5 of 2019 but in reality it did not go well because the dispensation given to obtain a marriage permit did not last long because it led to divorce so that the interests the child to be protected allegedly cannot be fulfilled. The main problem of the research is how is the effectiveness of granting dispensation for marriage at an early age due to pregnancy out of wedlock in Pekanbaru City in terms of Law Number 16 of 2019 Concerning Marriage, and what are the problems in granting dispensation for marriage at an early age due to pregnancy out of wedlock in Pekanbaru City . The research method is empirical legal research or sociological research, namely providing a systematic description of the implementation of the granting of dispensation for marriage at an early age due to pregnancy out of wedlock in Pekanbaru City in terms of Law Number 16 of 2019 concerning Marriage. while its nature is descriptive, namely where the author describes in detail and clearly the problem to be studied. The results of the study show that the effectiveness of granting dispensation for marriage at an early age due to out-of-wedlock pregnancy in Pekanbaru City in terms of Law Number 16 of 2019 concerning marriage is not yet effective because there are still many underage child marriages due to out-of-wedlock pregnancy experiencing divorce after obtaining permission to marry, even though in the process of implementation, the maximum dispensation from marriage has been granted in court and has a beneficial value to protect the child being conceived. Problems in Granting Marriage Dispensation at an Early Age Due to Pregnancy Out of Wedlock in Pekanbaru City is that the dispensation given to carry out marriages is not carried out as well as possible by the applicant parties because it leads to divorce even though the dispensation is given by the Religious Court so that the applicant obtains the right to marry marriage and the state recognizes the marriage and is registered at the Office of Religious Affairs (KUA) even though the age of the applicant has not reached the minimum age limit determined by laws and regulations and the applicant can be responsible for the child in providing a clear status to the child to be born.
