Abstract

Presidential Instruction number 5 of 2019 has instructed the Minister of Agrarian Affairs and Spatial Planning or the Head of the National Land Agency to stop the issuance of just two Land Rights, namely Cultivation Rights and Use Rights in Other Use Areas (APL) while Property Rights are not included in the instruction. Therefore property rights in other use areas (APL) are delayed in granting certificates to individual communities. The main problem in this research is the granting of land ownership certificates in the peatland area at the Indragiri Hilir District Land Office and the obstacles to granting land ownership certificates in the peatland area based on Presidential Instruction No. 5 of 2019 at the Indragiri Hilir District Land Office. In this research, the author applies his research method, namely empirical regulation, namely empirical regulation research, applies empirical regulatory case studies in the form of community regulatory behavior, then empirical regulatory research data sources do not conflict with written positive regulations, but according to the results observed at the research site. The nature of the analytical research used is descriptive analysis, which means to convey the progress of the meaning or subjective perspective as a guide so that the concentration of this research is on granting deed of land ownership rights in peatland areas according to Presidential Instruction No. 5 of 2019 in Indragiri Hilir Regency. The results of this research explain that the granting of land ownership rights in peatland areas according to Presidential Instruction number 5 of 2019 is carried out using the peatland area clarification method so that rights can be implemented to become land deeds as appropriate. And the obstacle to granting land ownership certificates in peatland areas according to Presidential Instruction No. 5 of 2019 is carried out by the method of the community preparing a history of land tenure before 2011 was issued as one of the conditions for submitting a request for clarification to the Forestry Planology.
