Abstract

ABSTRACT In marriage, there are often problems that end in divorce, where one of the reasons for the divorce is in the divorce agreement. However, to be brought to the Religious Courts, not everyone can prove this. So cases with this reason are seen from year to year, it is rare for people to use the excuse of divorce by taklik divorce. This research has a problem which is used as research material which is how to settle cases of violations of taklik talak and divorce at the Pekanbaru Religious Court and what are the positive and negative impacts on increasing the divorce rate and decreasing the number of violations against taklik divorce at the Pekanbaru Religious Court? The research method in this thesis uses an empirical approach. There is also what is called sociological research, in which legal research is primary data based on direct research into the field by conducting observations, interviews and documentation. The results of this thesis explain that settling divorce cases is tantamount to settling other cases, but to prove whether it is true or not to file a divorce suit is difficult. There are 4 contents of taklik divorce, namely leaving the wife for two consecutive years, not giving her the obligatory maintenance for 3 months, hurting the wife's body or body, allowing or not caring for the wife for six months or more. Among these 4 reasons, there are more dominant reasons, namely noncompulsory maintenance and the occurrence of domestic violence. However, what made the success of the Pekanbaru Religious Court was a stipulation or rule that had been stipulated, that is, if the wife reports her lawsuit, the wife will only pay an iwadh fee of Rp. 10,000 -, the price set is likened to how low a man's dignity is when a divorce lawsuit is reported by his wife. So, the existence of these provisions can minimize divorce caused by taklik divorce.
