Abstract

The Nagari Adat Density (KAN) is a Niniak Mamak Density institution that has been passed down from generation to generation as long as the custom functions to maintain the preservation of customs and resolve disputes over sako jo pusako. The existence of the Nagari Adat Density (KAN) has so far been considered unable to optimally resolve ulayat land disputes. Finally, disputes that have been resolved and those that have not been resolved by the Nagari Adat Density (KAN) lead to the District Court. The main problem of this research is how is the role of the Nagari Adat Density Institution (KAN) in the Settlement of Customary Land Disputes and What Factors are Inhibiting and Supporting the Nagari Customary Density Institution (KAN) in the Settlement of Customary Land Disputes The type and nature of this research includes empirical legal research, where this research goes into the field to obtain accurate data by means of interviews, and is descriptive in nature which explains in detail providing an explanation of the subject matter under study. The results of this study indicate that the role of the Nagari Adat Density (KAN) in Nagari Taram as a motivator by providing enlightenment to the disputing parties, then becoming a mediator who is neutral and impartial, as a peacemaker and decision maker through deliberation conducted by ninik mamak. which is incorporated into the Nagari Customary Density. While the inhibiting factors are internal factors caused by temperament, education, and discipline factors and external factors originating from third parties both from the family and community and supporting factors in the form of encouragement from all parties and the presence of witnesses and evidence.
