Abstract

Divorce is the release of the marriage bond between a man and a woman as husband and wife, which is carried out before a court hearing, namely the District Court for Non-Muslims and the Religious Court for those who are Muslim. To carry out a divorce there must be sufficient reasons as stated in Article 19 of Government Regulation Number. 9 of 1975 concerning the implementation of Law Number 1 of 1974 concerning Marriage. The problems in this study are as follows: First, what are the factors causing the high rate of divorce against lawsuits in Bagansiapiapi (Case Study of the Ujung Tanjung Religious Court). Second, Settlement of Responsibilities Due to Divorce Lawsuit at the Ujung Tanjung Religious Court in 2021. This study uses the Sociological Legal research method (empirical) or observational research which is descriptive in nature. Analysis is research that collects data by going directly to the field. The location chosen to conduct this research was at the Ujung Tanjung Religious Court. The results of this study are the factors that cause the high number of divorce cases in bagansiapiapi (Case Study of the Ujung Tanjung Religious Court) in 2021 seen from several factors including factors originating from the Judges of the Ujung Tanjung Religious Court, and the divorced party. The factors are disputes or quarrels, leaving one party and the economy. Settlement of responsibilities due to divorce sued at the Ujung Tanjung Religious Court in 2021 is by giving a decision on child custody and also maintenance rights.
