Abstract
The standard clause that is usually listed in online buying and selling transactions is not accepting returns or refunds which indirectly limits the consumer's right to obtain legal protection if the goods that have been agreed to order are not as expected when the goods are received by consumers through services. delivery of goods. The main problem in this study is How Consumers Protect Against Exoneration Clauses in Mobile Purchase Agreements Online Based on Law Number 8 of 1999 concerning Consumer Protection, What are the Legal Consequences of Inclusion of Exoneration Clauses in Online Buying and Selling Based on Law Number 8 of 1999 About Consumer Protection. The type of research used is included in empirical research, Empirical Legal Research is a legal research method that uses empirical facts taken from human behavior. While seen from its nature, this research is descriptive. Consumer protection for exoneration clauses in online agreements based on Law Number 8 of 1999 is basically not implemented properly and is very detrimental to consumers. Consumers do not have the freedom to contract while business actors in a more dominant position do not show good faith in buying and selling mobile phones online. The legal consequences of the inclusion of the Exoneration Clause in online buying and selling turned out to be misused by producers by providing conditions that were very detrimental to consumers because what was ordered online was not the same and different when received by consumers. Consumers cannot complete and consumers must accept the Exoneration Clause in the initial inclusion and the buyer cannot freely make an offer for the goods he will buy, so that this situation can be referred to as an abuse of circumstances
