Abstract

The principle of openness is the principle contained in Article 5 letter g of Law Number 12 of 2011 concerning the Establishment of Legislation. This principle explains that the formation of a statutory regulation should be carried out openly, starting from planning, drafting, discussing, ratifying to promulgation, all of which must be done openly. Likewise in the formation of Law Number 11 of 2020 concerning Job Creation which is considered not open. The purpose of this study is to find out the application of the principle of transparency in the formulation of Law Number 11 of 2020 concerning Job Creation and to find out the implications of not applying the principle of transparency in the formation of Law Number 11 of 2020 concerning Job Creation based on Law Number 12 of 2011 concerning Formation of Legislation. The research method used in this research is normative legal research, namely research that makes the law a system of norms, the norms in question regarding the principles and rules of legislation. The results of this study indicate that the application of the principle of openness in the formation of the Job Creation Act is not implemented, this can be seen from the number of people and interested parties who do not get the Academic Manuscript of the Draft Job Creation Act and also the draft of this Law. and the process of forming this law was carried out quickly and passed at midnight. The implications of not applying the principle of openness are the occurrence of formal defects, disinformation in the community, and the result of unconstitutional enforcement.
