Abstract
The agreement is an important foundation for establishing rights and obligations and legally binding one party to another. The agreement is also a crucial aspect of the Government Cooperation with Business Entities (KPBU). KPBU explores various sectors, one of which is the drinking water sector. The Drinking Water Supply System (SPAM) project marks the beginning of a legal relationship between the Government and PT. PP Tirta Madani in Pekanbaru City. This research aims to understand the implementation of the agreement in the Drinking Water Supply System (SPAM) development project and to identify the obstacles faced by PT. PP Tirta Madani in executing the Drinking Water Supply System (SPAM) development project in Pekanbaru City. The main issue in this research is how the implementation of the agreement in the development project of the Drinking Water Supply System (SPAM) by the Pekanbaru City Government and PT. PP Tirta Madani in Pekanbaru City is carried out, and what obstacles PT. PP Tirta Madani faces in executing the development project of the Drinking Water Supply System (SPAM) in Pekanbaru City. The research method employed by the author is the empirical legal research method. Empirical legal research involves field studies through the observation of actual events and the application of legal principles in the context of real events based on information from primary, secondary, and tertiary legal sources. Its nature is descriptive-analytical, which describes the analysis process of the information collected from field results, interviews, documents, and observations to develop a thesis that clarifies the issues related to the chosen title. The research findings conclude that the implementation of this construction project agreement involves several stages, including a feasibility study, project approval by the Pekanbaru City Government, and the establishment and appointment of the project executor. The implementation of this project largely aligns with the principles of the agreement as stated in Article 1338 of the Civil Code. Furthermore, there is a primary obstacle, which is non-compliance with the applicable regulations as stipulated in Article 5A paragraph (1) of Regional Regulation Number 5 of 2022. This indicates that financial and regulatory issues often become factors in the delays of a PPP project. Additionally, the majority of PDAM customers feel satisfied; however, 30% of customers experience technical difficulties such as low water quantity, leaking pipes, broken meters, and so on. This suggests that water distribution and infrastructure remain significant issues in the implementation of the SPAM project in Pekanbaru.
