Abstract

It is the government's obligation to improve public health, particularly health services. The government, as the health provider, is empowered to ensure public health. However, the current situation shows that the BPJS Kesehatan (Social Security Agency for Health), established by the government to ensure the health of the Indonesian people, is not fully functioning. This is demonstrated by numerous public complaints about poor service provided by BPJS Kesehatan partner hospitals, which are considered unprofessional, including the provision of inappropriate medication. The main questions in this thesis are: first, What is the legal relationship between patients at Awal Bros Hospital and BPJS Kesehatan? And second, What obstacles do patients face in accessing BPJS Kesehatan services at Awal Bros Hospital? This research is empirical. The research location is Awal Bros Hospital in Pekanbaru City. The respondents and sample in this study are one Head of Awal Bros Hospital, one Head of BPJS Kesehatan, and 100 patients who received services. Data collection tools in this study include interviews, questionnaires, and documentation. Data analysis used is qualitative analysis because legal studies rely on existing legal standards. To draw conclusions, the author will use a deductive approach, drawing conclusions about what is specific and what is general. The results of this study are: First, the legal relationship between patients at Awal Bros Hospital and BPJS Kesehatan (Indonesian Social Security Agency for Health). Patients accessing BPJS Kesehatan services at Awal Bros Hospital is based on regulations governing patient rights and obligations. These regulations establish a legal relationship between patients and Awal Bros Hospital in Pekanbaru, including legal protection. One such legal relationship is based on Law Number 24 of 2011. Second, the obstacles faced by patients accessing BPJS Kesehatan services at Awal Bros Hospital include the extensive administrative procedures, such as processing referral letters or submitting claims. This often leads to confusion, especially for those unfamiliar with bureaucratic procedures. Furthermore, costs are a factor: the hospital must cover the costs of BPJS Kesehatan patients' treatment while awaiting payment from BPJS Kesehatan, which is often delayed for months.
