Abstract

An agreement is formed when there is an agreement between two parties that are mutually bound. In order to meet the needs of the house, it can be done with a rental agreement between the homeowner and the tenant. Arental agreement can be realized unwritten as long as it does not conflict with applicable law. However, when implementing an agrrement, sometimes one party or even both parties do not fulfill what has been agreed upon which results in losses. In addition, there is a lack of understanding from both parties regarding the agreement that has been designated as such. The purpose of this study is to describe how important is to have written evedance when drafting an agreement. The formulation of the problems in this study is: 1) How is the implementation of unwritten rental agreements in contract house located on Karya Bakti Bambukuning Sub-district Pekanbaru City?, 2) How to resolution disputes regarding unwritten rental agreements in contract house on Karya Bakti Bambukuning Sub-district Pekanbaru City?. The method applied by researchers in this study is observational research by means of direct survey in the field inolving interview with the population and samples. On the other hand, the nature of this research is descriptie. There are two sources of data used, namely primary data and secondary data. After the collection in the is complete, the author will present sentences according to the qualitative analysis method. To draw conclusions, the author applies the inductive method. Based on the research findings, it can be concluded that the parties involved made an unwritten lease agreement that triggered difficulties in proof and non- complianse with the rights an obligations of the parties, resulting in losses such as delays in rent payments and the obligation to pay compensation for damage experienced to the contract house. In dealing with disputes that arise, the parties prefer to resolve the problem thorugh deliberation or a family approach (nonlitigation) so that the parties can negotiate and negotiate well with each other.
