Abstract
Land transportation plays a vital role in facilitating public mobility and supporting social and economic activities. However, the increasing demand for transportation services has led to the rise of illegal travel operators operating without official route permits. This practice violates legal regulations, endangers passenger safety, creates unfair business competition, and reduces the potential for regional revenue (PAD). This study aims to analyze the application of criminal sanctions against unauthorized travel operators by the Riau Province Department of Transportation and to identify the challenges in its implementation. The research uses a descriptive qualitative approach, with data collected through interviews, observations, and documentation studies. Primary data sources include the Department of Transportation of Riau Province, traffic police, illegal travel operators, and users of such services. The study is also supported by analysis of relevant legal frameworks, including Law No. 22 of 2009 on Road Traffic and Transportation, Ministerial Regulations, and applicable local regulations. The findings indicate that criminal sanctions have been applied through enforcement operations, administrative penalties, and joint police raids. However, the implementation remains suboptimal due to several obstacles such as weak institutional coordination, limited human resources, high costs and complexity of the permit application process, and a permissive legal culture among the public. Additionally, the imposed penalties tend to be light and have not provided a strong deterrent effect. This study emphasizes the need for stronger legal enforcement and continuous regulatory reforms. Collaborative efforts among the Department of Transportation, police, and other authorities are essential to encourage compliance among transport service providers. Public education and simplification of permit procedures are also crucial in minimizing illegal transport operations. Ultimately, the goal is to establish a safe, orderly, and law-abiding transportation system aligned with the principles of justice, utility, and legal certainty in criminal law.
