Abstract

From 2020 to 2023, marriage dispensation requests have consistently been filed, reaching a total of 179 applications. This dispensation is a form of leniency provided by the Law through the Religious Court for minors to marry, based on Law Number 16 of 2019, which amends Law Number 1 of 1974, Article 7, Paragraph (2). The author conducted this research at the Religious Court of Pekanbaru. The objective of this study is to examine the regulations on granting marriage dispensation for minors and the implementation of this dispensation at the Religious Court of Pekanbaru. This research employs an empirical legal research method, using a field research methodology. The data sources include both primary and secondary data, and the data collection method involves interviews. The conclusion is drawn using a deductive approach, starting from general principles and moving to specific cases. The findings of this thesis are as follows: First, the regulations for granting marriage dispensation are based on the Marriage Law, PERMA No. 5 of 2019, and the considerations made by the judges. Second, the implementation of marriage dispensation for minors at the Religious Court of Pekanbaru has been in accordance with the applicable regulations, with the judges prioritizing the best interests of the child when either accepting or rejecting the request.
