Abstract

Premeditated murder, or in legal terms known as moord, is a type of serious crime that endangers human life and is expressly regulated in Article 340 of the Criminal Code. This crime has characteristics that distinguish it from ordinary murder, as regulated in Article 338 of the Criminal Code, although both are classified as violations of a person's right to life. Premeditated murder has an additional element that is not present in ordinary murder, namely that the act is carried out with prior planning. This shows that the perpetrator has thought about and planned his actions deliberately and carefully. The main problem in this research is how the law is applied in court to perpetrators of premeditated murder in cases, and what are the legal considerations of judges in premeditated murder cases. The nature of the research in this thesis uses a descriptive analysis method, namely a method that intends to provide an overview, as well as study, examine concepts, theories and provisions in regulations related to the problems in this thesis. The writing of this thesis is also a library research on secondary data. Based on the results of the research conducted by the author, it can be concluded that Nofaldy Saputra alias Nopal bin Amrizal was proven guilty of committing the crime of premeditated murder, so that the Pekanbaru City District Court sentenced him to 20 years in prison in accordance with Article 340 of the Criminal Code, with the period of arrest and disappearance that has been served being deducted from the sentence imposed, while the arrestee remains detained during the legal process; the confiscated evidence includes a Honda Vario 125 motorcycle, motorcycle keys, helmet, backpack, driving license in the name of Deri Kurniawan, and an Oppo cellphone type CPH 1911.
