Abstract

Legal protection is a means or effort to create peace, tranquility, and order, so that with protection, relationships between individuals or communities can be maintained to avoid disputes. This study aims to examine how creditors are protected in relation to collateral based on Law -Law No. 4 of 1996 in credit agreements where the collateral object is located in a forest area. This legal status prevents the collateral object from being transferred, thereby complicating the execution process and potentially harming creditors in the future. The main issue in this study is how to provide legal protection for creditors regarding collateral that cannot be executed because it is located in a forest area, using the case study of PT. Bank Mandiri Tbk KCP Ujungbatu, Rokan Hulu Regency, Riau Province, and what factors cause collateral to be located in a forest area, using the case study of PT. Bank Mandiri Tbk KCP Ujungbatu, Rokan Hulu Regency, Riau Province. The research method used is legal-empirical, where the researcher will conduct fieldwork to collect data, which will then be compiled through literature review and interviews with relevant parties, followed by analysis. Based on the results of the research conducted by the author, it was found that the current legal protection, namely Law No. 4 of 1996 on Mortgage Rights, is still not fully effective in protecting creditors, as there are no explicit legal provisions regulating mortgage objects within forest areas. The factors causing collateral objects to fall within forest areas include changes in legislation, regional spatial planning policies, inconsistencies in data between the Department of Environment and Forestry (DLHK) and the National Land Agency (BPN), and negligence on the part of notaries/land deed officers (PPAT) in conducting a comprehensive verification of land status.
