Abstract

The National Agency of Drug and Food Control (BPOM) is a non-ministerial government institution responsible for supervising drugs, food, cosmetics, traditional medicines, health supplements, narcotics, psychotropics, and addictive substances, as stipulated in Presidential Regulation No. 80 of 2017. BPOM conducts both pre-market and post-market surveillance to ensure the safety, efficacy, and quality of products available in the Indonesian market. Despite intensive supervision, many illegal cosmetics continue to circulate without official distribution permits and are suspected of containing hazardous substances such as mercury, hydroquinone, lead, and toxic dyes. This situation clearly contradicts the provisions of Law No. 8 of 1999 concerning Consumer Protection and Law No. 36 of 2009 concerning Health. The primary issues addressed in this study are: How does BPOM Pekanbaru play a role in supervising the circulation of illegal products containing hazardous substances. And how is consumer protection implemented concerning the circulation of such illegal products in Pekanbaru City. This research employs an observational study design with direct field surveys. The method allows the researcher to collect primary data through in-depth interviews with various stakeholders, including BPOM officials, cosmetic consumers, and business actors involved in the distribution of illegal cosmetics. Secondary data is gathered through documentation of BPOM’s official reports and related literature. This study is descriptive in nature, providing a clear and detailed depiction of the issues. Based on the research results, the role of the Pekanbaru POM Center is to carry out government duties in accordance with Presidential Regulation No. 80 of 2017. However, its implementation has not yet achieved its objectives optimally. Most cosmetic products available in several stores generally have distribution permits from BPOM and are safe for sale. However, there are still some illegal cosmetic products that are proven to contain hazardous materials. Consumer protection against the circulation of illegal cosmetic products is by conducting continuous supervision and consumers can report problems they experience directly or make reports to the Food and Drug Supervisory Agency so that they can be followed up legally and given criminal or administrative sanctions in accordance with applicable laws. Legal regulations related to the circulation of cosmetics in Indonesia include Law Number 8 of 1999 concerning Consumer Protection, Law Number 36 of 2009 concerning Health.
