Abstract

The problem in the research raised by the author is regarding the Implementation of Customary Heritage Law in Pulau Panjang Village, Cerenti District, Kuantan Singingi Regency reviewed from the perspective of Islamic Law. Because considering that the local people who choose the distribution of inheritance are more likely to only go to daughters which is very contrary to the inheritance system in Islamic law where the distribution of inheritance is based on patrilineal descent. In this study, the author formulates 2 (two) problem formulations, namely How to Implement Customary Heritage Law in the Community in Pulau Panjang Village, Cerenti District, Kuantan Singingi Regency, and How to Review Islamic Law on the Implementation of Customary Heritage Law in Pulau Panjang Village, Cerenti District, Kuantan Singingi Regency. This research uses a type of empirical or sociological legal research which is an approach by looking at a legal reality in society. Where in this study, the researcher went to the field to see events that occurred in the community by means of observation and also interviews to obtain data and find information about the system of distribution of customary heritage in Pulau Panjang Village, Cerenti District, Kuantan Singingi Regency reviewed from Islamic Law. The results of the study prove that the people in Pulau Panjang Village, Cerenti District, Kuantan Singingi Regency in the implementation of the distribution of inheritance are not in accordance with the provisions of Islamic law.The heirs according to the custom of the people of Pulau Panjang Village are girls, if there are no girls, then the heirs are boys, if there are no children, then it is measured in inches and a cubit (the closest relatives). After being reviewed according to Islamic law, the implementation of the traditional distribution of inheritance in Pulau Panjang Village has deviated, there is injustice and changes the provisions of Allah and His Messenger. Unless all heirs have given up on each other, after mentioning the share of each heir according to Islamic law.
