Abstract

Globalization in the economic field has an impact on global competition that must be faced thoroughly throughout the world. Thus, this condition gave birth to intense and sharp competition, and gave the tendency for nations to beat each other in the global market. The injustice felt by the German side of the Versailles treaty became one of the factors behind the outbreak of the World War II where Germany began to attack Danzig, Poland on September 1, 1939. The attack. Which lasted for 6 years, and ended in 1945. The division of West Germany and East Germany also had a strong influence in the field of business competition. In this Bachelor Thesis entitled “The analysis of evidentiary issues of Parallel Market Behavior and Concerted Anti-Competitive acts in the perspective of German Law and Indonesian Law” which consist of two main problems, such as : The implementation of concerted anti-competitive acts and Parallel market behavior and Challenges in proving concerted anti-competitive acts and Parallel market behavior. The research method used to address the problems mentioned above utilizes normative legal research methods where normative research focuses on the object of norms that are continued or manifested in a specific legal regulation. While seen from the nature of this research is analytical description. The results of the research show that the implementation of organized anticompetitive acts and parallel market behavior from the perspective of different countries in obtaining evidence are the core of this bachelor thesis, thus materializing into an analysis of evidentiary issues of Parallel Market Behavior and Concerted Anti-Competitive acts in the perspective of German and Indonesian legal contexts using normative legal research methods supported by numerous types of approaches in the form of a statutory approach, conceptual approach, case approach, and historical approach. This research will observe the enforcement of anti-competitive law and parallel market behavior in the two countries and examine how the authorities resolve a case the occurs in accordance with competition law in each country, which is supported by case examples that have been encountered, both in Germany and Indonesia.
