Abstract
Problems that occur at PT. Federal International Finance (FIF) Pekanbaru Branch. Financing is provided by PT FIF Pekanbaru branch with a credit system, but the financing system contains many risks, including debtor default or bad credit where the debtor breaks promises because he cannot pay installments or installments. Default made by the debtor then the efforts taken by the creditor are through notification of late payment through direct calls or providing warning letters. If payment has not been made after the warning letter, the last resort taken is the settlement step by executing the fiduciary security object, either through a public auction sale or underhand sale. The problem in this study is how to resolve defaults in motor vehicle consumer financing agreements at FIF Pekanbaru and how obstacles arise in resolving defaults of motor vehicle consumer financing agreements at FIF Pekanbaru. The method used to answer the focus of research mentioned above is to use empirical legal research methods, namely by conducting interviews and observations. Meanwhile, judging from its nature, this research is descriptive analytical. Based on the results of the study, it is known that there are 3 stages of settlement efforts. First, PT FIF Pekanbaru branch will hold negotiations with consumers. Second, through Giving Warnings to Debtors. Third, if the last subpoena is also not responded to, PT. FIF Pekanbaru branch will execute or confiscate motor vehicles that are the object of financing in the hands of debtors. After the financing object was confiscated, PT. FIF Pekanbaru branch will conduct an auction of the financing object. Constraints in resolving defaults in consumer financing agreements at PT. FIF Pekanbaru branch is an obstacle in terms of internal and external. Internal constraints were caused by the internal parties of the FIF Pekanbaru branch itself which was not qualified in its field, causing negligence in work. External constraints are caused by consumers themselves who are less cooperative in resolving consumer financing defaults.
