Abstract

The development of technology such as video games (video games), causing problems related to virtual items in an online game is a virtual item owned by players in the online game. Virtual trading of this item is mostly done in the real world, it happens all over the world, including in Indonesia, There are online game service providers that allow buying and selling and some prohibit it, because of the many types of virtual items and the variety of term and conditions settings in each different game. The formulation of the problem in this study is: 1) What is the position of buying and selling virtual items in online games based on applicable legal provisions in Indonesia? 2) What is the mechanism for buying and selling virtual items in online games? In this study, the author uses a type of normative method with the nature of analytical research. The author conducted research by examining laws and regulations related to the issue of virtual items in an online game to obtain data in this study. Then to help strengthen the primary data, researchers examine secondary data in the form of books, journals and other scientific papers related to virtual items. The position of virtual items in property law in Indonesia can be known by analyzing the provisions of Article 499 of the Civil Code which states that property is every item and every right that can be controlled by property rights. The ownership rights (eigendom) over virtual items in online games are held by service providers regulated in Article 570 of the Civil Code, while the player only has the right to control (bezit) over virtual items in the game, this is regulated in Article 529 of the Civil Code. Based on Article 1 point 1 of Law Number 11 of 2008 concerning Electronic Information and Transactions, virtual items are included as Electronic Information and based on Article 1 number 19 of Government Regulation Number 80 of 2019 concerning Trading Through Electronic Systems, Virtual items can be referred to as Digital Goods. The mechanism for buying and selling virtual items can be done directly between fellow players or through third parties.
