Abstract

The implementation of the work on the Bagan Jaya-Kuala Enok-Rumbai Jaya-Tempuling-Tembilahan Road Preservation Supervision between the Directorate General of Highways of Riau Province and PT. Arci Pratama Consultant And CV. Buhara Persada has violated the contents of the contract, meaning that the supervision work is not effectively carried out by PT. Arci Pratama consultant and CV.Buhara Persada on the grounds that the implementing contractor, namely PT. Dewanto Cipta Pratama was late in doing field work. The supervisory consultant, namely PT. Arci pratama consultant and CV.Buhara Persada were considered negligent in reprimanding PT. Dewanto Cipta Pratama as the implementing contractor to work according to the specified progress for 11 (eleven) months, with a contract value of Rp. 50,987,404,000 (fifty billion nine hundred eighty-seven million four hundred four thousand rupiah). Based on the background of the problems described above, the authors determine the main problem, namely: how is the implementation of the cooperation agreement between the Directorate General of Highways of Riau Province and PT. Arci Pratama consultants and CV. Buhara Perasada in terms of monitoring road preservation as well as inhibiting factors in the Implementation of the Cooperation Agreement between the Directorate General of Highways of Riau Province and PT. Arci Pratama consultants and CV. Buhara Persada in terms of road preservation supervision of Jalan Bagan Jaya-Kuala Enok- Tassel Jaya-Tempuling –Tembilahan This research can be entered into sociological legal research by means of survey research. The type of legal research conducted is empirical research. Primary data are direct interviews. Secondary data from contract documents, literature and laws and regulations related to research. Based on research on the Review of Defaults on the Implementation of the Preservation Supervision Cooperation Agreement for Jalan Bagan Jaya-Kuala Enok-Rumbai Jaya-Tempuling –Tembilahan between the Directorate General of Highways of Riau Province and PT. Arci Pratama Consultant and CV Buhara Persada are known to be in breach of contract. as a service user, there are rights and obligations that must be fulfilled by both parties, while the inhibiting factor in the implementation of the agreement is that PT Dewanto Cipta Pratama does not fulfill the progress of the work, because PT. Dewanto Cipta Pratama also found work in other areas, so that the mobility in doing this work was not optimal, and because PT. Dewanto Cipta Pratama and did not meet the progress of the work, the supervisory consultant, namely PT. Consultants Arci Pratama and CV.Buhara Perasada were also considered negligent in supervising the work carried out by the contractor PT. Dewanto Cipta pratama.
