Abstract
Implementation of registration of births of children in unregistered marriages based on Law no. 24 of 2013 faces several problems, including a lack of public knowledge regarding the applicable population administration process which can cause difficulties in reporting the birth of foreign children in unregistered marriages. In addition, there are limited resources at implementing agencies, which slows down the birth registration process. Incompatibility of documents such as birth certificates from hospitals or doctors, which may not always be available or complete, thus slowing down the reporting process to the Anambas Islands Regency Population and Civil Registry Service. Based on the phenomena in the background, this research aims to examine and analyze the implementation of registration of births of children in unregistered marriages in Anambas Islands Regency as well as legal protection for children born from unregistered marriages in Anambas Islands Regency. This research is included in the group of normative juridical research. The normative juridical approach is legal research that places law as a building system of norms. Empirical juridical research is research that has as its object the study of the registration of births of children in unregistered marriages in the Anambas Islands Regency. The results of the research show that the Implementation Process of Minister of Home Affairs Regulation Number 108 of 2019 concerning the Permissibility of Registering Children of Marriages Has Not Been Registered. By including the status "Unregistered Marriage" in the family card, it is legal in accordance with the substance of the regulation to distinguish between residents who have or have not had a marriage certificate issued by the Office of Religious Affairs (KUA) issued through the Population and Civil Registration Service by attaching a statement of absolute responsibility. Legal Protection for Children Born from Unregistered Marriages in Anambas Islands Regency from a Positive aspect provides children's rights in terms of administration so as to provide certainty regarding marital and relationship status and regarding the child's origins (who is the father and mother) in the family on the family card. From the negative aspect, it weakens the authority of marriage registration institutions, the Office of Religious Affairs and the Office, narrows the authority of the judiciary in terms of determining (istbat) an unregistered marriage. Contradicts Law Number 16 of 2019 regarding marriage registration.
