Abstract
Law Number 11 of 2021 Amendment to Law Number 16 of 2004 concerning the Attorney General's Office of the Republic of Indonesia The Attorney General's Office of the Republic of Indonesia is a State Institution authorized by the state in the field of implementing court decisions that have obtained permanent legal force. behind the rampant cases of corruption in Indonesia, which have harmed state finances from small to large amounts, the prosecutor's office has an important role in law enforcement efforts as investigators, prosecutors, executioners and implementing judges' decisions. and the role of the prosecutor's office in returning state losses is very important, especially in the research area of the Ngeri Tanjungpinang Prosecutor's Office and in implementing the return of state losses, the prosecutor's office also faces obstacles and constraints. The main problem in this study is the first Role of the Tanjungpinang District Attorney's Office in Enforcing the Law on the Return of State Finances from Corruption Crimes. Second, Obstacles to the Tanjungpinang District Attorney's Office in Efforts to Enforce the Law on the Return of State Finances from Corruption Crimes. In this study, the researcher used an observational research type conducted by means of a survey, namely direct research to the research location using a data collection tool in the form of interviews. While the technique of drawing conclusions, the author draws conclusions using an inductive mode, namely drawing conclusions from general things to specific things. The Role of the Tanjungpinang District Attorney's Office in the Corruption Case that the researcher raised in Case No. 05 / pid.sus-TPK / 2019 / PN.TPG The return of state financial losses on the replacement money by the defendant has been paid in full in installments. The funds were returned to the state through the treasurer and deposited with the RPL of the Red Plate Bank, Bank Mandiri Tanjungpinang. The obstacles faced by the Tanjung Pinang District Attorney's Office in returning state finances can be seen from legal factors, law enforcement, facilities and community culture, such as asset tracking, most of the defendant's assets are in the name of other people, from friends to close family who help the defendant hide their assets, so that the investigating prosecutor has difficulty in finding the defendant's assets.
