Abstract

ASEAN Economic Community (AEC) encourages free-trade in ASEAN country members. AEC creates opportunity and challenge that must be faced by indigenous peoples or communities owning Creative Economy products, one of communities is Talang Mamak indigenous peoples who live and grow in Indragiri Hulu, Riau Province. Creative Economy products from Talang Mamak indigenous peoples, namely handcraft, art show, and traditional culinary, should be protected and empowered with the existing law that will take benefit from the opportunity and face the challenge from AEC. The research aims to see the implementation of law about creative economy to Creative Economy products that be produced and distributed by Talang Mamak indigenous peoples in facing AEC. Type of research methodology used in this research is legal research of sociological juridical. The norm of this research is analytical descriptive. Collecting data tool used is primary and secondary legal materials. Data collection procedurals apply questionnaire and legal literature review. The data will be analyzed based on qualitative approach. The result of this research is First, there are several legislation products that provide the legal protection for indigenous peoples in facing challenges and take benefits from AEC, namely Law Number 24 of 2019 about Creative Economy, Government Regulation Number 24 of 2022 about Derivative Regulation about Law Number 24 of 2019, and President Regulation Number 142 of 2018 about Masterplan of National Creative Economy Development 2018- 2025. Second, those legislation products have not been effective in providing legal protection for Creative Economy products produced by Talang Mamak indigenous peoples in facing AEC due to Masterplan Creative Economy in Indragiri Hulu has not been integrated yet and public service agency that support funding scheme based Intellectual Property Rights and/or Distribution System of Creative Economy Product based Intellectual Property has not been exist.
