Abstract
Victims of rape are also entitled to medical assistance and psychosocial and psychological rehabilitation assistance as stipulated in Article 6 of the Law on Sanctions and Victim Protection. This assistance is a service provided to victims and/or witnesses by the Sanctions and Victims Protection Agency, however this assistance cannot yet be implemented by the LPSK in the area, especially in the jurisdiction of the Tapung Hilir Police. Because those who provide medical assistance and psychosocial and psychological rehabilitation assistance are carried out by the District Social Service so that the victim does not feel optimally because the victim is traumatized so that the victim is more self-isolated and feels afraid. The main problem of the research is how is the form of legal protection for victims of criminal acts of rape in the investigation phase in the jurisdiction of the Tapung Hilir Police, and what are the obstacles in providing legal protection for victims of criminal acts of rape in the investigative stage in the jurisdiction of the Tapung Hilir Police. The research method is of the type of legal research observational research or survey. While its nature is descriptive, namely where the author describes in detail and clearly the problems to be studied. The results of the study show that the form of legal protection for victims of rape in the investigation phase in the jurisdiction of the Tapung Hilir Police is not running optimally because the victim is only given protection in the form of assistance and the victim is placed in a temporary residence which lasts for 5 days but the right to rehabilitation/recovery for the victim was not given, because the investigators only carried out investigations such as making reports and for the purpose of post mortem at repertum. Regarding the cost of the need for clinical psychological counseling for victims, it is the victims themselves who incur the costs and not the police or others. Because from the police, there are no medical services, especially those related to clinical psychological counseling, and obstacles in providing legal protection for victims of criminal acts of rape during the investigation stage in the jurisdiction of the Tapung Hilir Police are that children do not have lawyers who specifically handle cases and there are no psychologists. for victims at the time of investigation as well as budget problems for handling cases and the unavailability of safe houses for victims which makes it difficult to handle victims and it is difficult for victims to express what happened.
