Abstract

Plaza Senapelan Shopping Center is one of the famous shopping centers for buying and selling mobile phones and mobile phone repair services in Pekanbaru. Plaza Senapelan shopping center is one of the main destinations for the people of pekanbaru city with the aim of repairing their cellphones. The existence of the parties providing mobile phone repair services provides mobile phone repair services as their daily livelihood on the other hand the buyers of mobile phone repair services, aiming to repair their mobile phones. The sale and purchase agreement is applied according to the Civil Code, then how about the implementation of the sale and purchase agreement of mobile phone repair services between repair service providers and buyers of mobile phone repair services and how to compensate for the default of mobile phone repair services according to the Civil Code by repair service providers against buyers of mobile phone repair services at Plaza Senapelan shopping center. The method of approach used by researchers in this research is empirical legal method. When viewed from the type, this research is included in the observational research group conducted by direct research using data collection tools in the form of interviews, questionnaires, and documentation. Data analysis is done qualitatively. This means that the data is described, compared or connected based on laws, opinions of legal experts as well as legal theories that have relevance to the research. The inference method used by researchers uses a deductive withdrawal method. Research using the Deductive method is the withdrawal of things that are general into things that are specific. The results of the study explain how the implementation process in the daily sale and purchase agreement of mobile phone repair services both from the point of view of the repair service provider and from the point of view of the buyer of mobile phone repair services, researchers explain step-by-step based on the data that researchers get in the field. Furthermore, namely how compensation in default made by mobile phone repair service providers against buyers of mobile phone repair services at the Plaza Senapelan shopping center. In practice, it is still not running in accordance with the provisions of the Civil Code.
