Abstract
The obligation of Halal certification for all food and beverages is regulated in Article 4 of Law Number 33 of 2014 concerning Halal Product Assurance explaining that products entering, circulating and traded in Indonesia must have a halal certificate. Every producer who will market their products in the territory of Indonesia is required to carry out halal certification and obtain a halal certificate. Thus, if the manufacturer already has a halal certificate, he must also include a halal label on the product packaging as information to consumers that the packaged food is halal and safe for consumption. In this research, there are several formulations of legal problems, namely as follows. First, How is the implementation of consumer protection for Mixue ice cream in Pekanbaru City that has not included the Halal label but has been marketed based on Law Number 33 of 2014 concerning Halal Product Guarantee?, Second, What are the obstacles in providing consumer protection for Mixue ice cream that only includes the Halal label after being marketed? For this study, the author uses a type of empirical legal research, namely by diving into the field to obtain a number of data. The data and data sources that the author uses are primary and secondary data, as for the data collection techniques that the author uses, namely using observation, interview and documentation techniques. While the method of drawing conclusions that the author uses in this study is the deductive method, which is to draw conclusions from general to specific things. From the results of research and discussion that the author found are as follows: First, the implementation of consumer protection provided by Mixue Ice Cream business actors in Pekanbaru City to consumers has not been carried out, because business actors have marketed their products before obtaining Halal certification from the Indonesian Ulema Council, which is not in accordance with Article 4 of Law Number 33 of 2014 concerning Halal Product Assurance which reads "Products that enter, circulating, and traded in the territory of Indonesia must be Halal certified." Second, obstacles in providing consumer protection for Mixue ice cream which has just included the Halal label after being marketed are seen from two sides, namely obstacles from business actors to consumers of Mixue Ice Cream in Pekanbaru City, namely the delay factor from the central Mixue in taking care of Halal certification, the factor of raw materials used from abroad and the Covid-19 pandemic factor. Then the obstacle factor of Mixue K.
