Abstract

Negligent implementation of the agreement in carrying out its obligations in the cooperation agreement rules. In the cooperation agreement there is a breach of contract. Default is a situation where a debtor is considered negligent after the time period specified in the agreement has passed. The main problem of this research is the breach of contract that occurred in the cooperation agreement for the sale and purchase of andesite raw material with the parties Mr. Rudi Harsono as the buyer and Mr. Tessa Arief Budiman as the seller, where Mr. Tessa Arief Budiman did not make the payment as agreed. The problems in this thesis research are as follows. First, how is the implementation of the cooperation agreement for the sale and purchase of raw andesite stone materials? Second, what are the forms of default in the implementation of the cooperation agreement on the sale and purchase of raw andesite stone materials? For this research, the author used a type of empirical legal research, (Observational Research), namely by going into the field to obtain some data. The data and data sources that the author uses are secondary data, while the data collection techniques that the author uses are observation, interview and documentation techniques. Meanwhile, the method of drawing conclusions that the author uses in this research is the deductive method, namely drawing conclusions from general to specific matters. From the results of the research and discussion, what the author found is as follows: First, the implementation of the cooperation agreement for the sale and purchase of andesite raw material between Mr. Rudi Harsono and Mr. Tessa Arief Budiman is not running properly, where Mr. Tessa in the first agreement only paid the profit seven times. from the supposed ten times payment, the second agreement was only paid twice, in the third agreement the money paid was still less than eighteen million rupiah. The two defaults that occurred in the cooperation agreement for the sale and purchase of raw andesite stone materials between Mr. Rudi Harsono and Mr. Tessa Arief Budiman were late payment by Mr. Tessa in the first agreement, three to four weeks late, in the second agreement, two months late, inconsistency with the agreement, namely Mr. Tessa did not return Mr. Rudi Harsono's capital, and Mr. Tessa did not fulfill the agreement, namely the payment of profits that had not been completed.
