Abstract
The Sale and Purchase Agreement (PPJB) is a provisional preliminary or preliminary agreement that aims to bind the parties, namely the sellers and buyers due to the requirements in the land sale and purchase process that have not been fulfilled for the implementation of the Sale and Purchase Deed (AJB) in front of the Land Deed Making Officer (PPAT). Based on the background that has been explained above, the problems that will be discussed in this study are how the process of implementing PPJB in the transfer of land rights in the transfer of land rights in Jorong Sitapuang, Ampek Angkek District, Agam Regency, West Sumatra Province and how is the legal certainty of PPJB in the transfer of land rights in Jorong Sitapuang, Ampek Angkek District, Agam Regency, West Sumatra Province. The type of research that the author uses in writing this thesis uses sociological laws, which this research looks at from the situation in the field. The population and sample withdrawal in this research is by purposive sampling, which is sampling that is only adjusted to the purpose of the research. The population in this study is 3 people, including notaries, sellers and buyers. This research is located in Jorong Sitapuang, Ampek Angkek District, Agam Regency, West Sumatra Province. Based on the results of the study, it is known that the implementation of PPJB in the transfer of land rights cannot be a factor for the transfer of land rights because it is still in the form of a preliminary agreement to be a condition for making an AJB if the PPJB has been fulfilled. In order to ensure legal certainty, PPJB should use an authentic deed made before a notary so that it becomes a strong evidence in the case of default.
