Abstract

In Pekanbaru City, not a few used cars whose defects are unknown or have hidden defects regarding the condition of the used car engine. The car often breaks down and is difficult to function again. It is known that at that time the engine of the car contained hidden defects. In the sense of the condition of the machine that has been damaged and difficult to repair. If repaired, it will take a long time and at a cost that is not cheap. This makes the author interested in conducting further research on this used car buying and selling transaction to find out about the form of legal protection for consumers for engine defects in buying and selling used cars and what kind of solution to the problem of engine defects in buying and selling used cars. This thesis contains a formulation of the problem, namely: how is the legal protection for consumers for engine defects in buying and selling used cars in Pekanbaru City in 2022? and how to solve problems with engine defects in buying and selling used cars in Pekanbaru City in 2022. The method used to answer the goals mentioned above is to use empirical legal research methods, which is a data collection technique, where researchers make direct observations to the object of research to see closely the activities carried out. Data collection is done by interviews, and questionnaires. The results of the study show that there is no and no implementation of consumer legal protection for engine defects in buying and selling used cars in Pekanbaru City in Pekanbaru City. First, because the business actor defaults on the agreement where the agreement says that "1 (one) month warranty guarantee for the engine and transmissionHowever, the reality is that business actors do not process the warranty submitted by consumers for engine defects in used cars that have been purchased by consumers. Second, in the deed of sale and purchase agreement it is stated that "Dispute Resolution can be done through deliberation, consensus and through legal channels". Solving Problems for Engine Defects in buying and selling used cars in Pekanbaru City is taken by consumers through non-litigation channels in the form of negotiations in the form of deliberation. Negotiation is chosen as the first effort by buyers because it goes through a negotiation process to obtain an agreement between consumers and business actors. However, the negotiation route is not effective in this case. This is because business actors do not intend to listen to consumer complaints. Business actors also do not heed the good intentions of consumers to negotiate in the form of deliberation/consensus.
