Abstract

Law Number 33 of 2014 as a legal basis provides legal protection for Muslim consumers against uncertainties in the use of various halal food and beverage products both in the form of goods and services in accordance with Islamic legal obligations. The authority to issue halal certification has now officially shifted to the hands of the government. The government has formed the Halal Product Assurance Organizing Agency (BPJPH) to administer halal product guarantees (JPH), which was previously under the authority of the Indonesian Ulema Council (MUI). The birth of BPJPH is a mandate from Law Number 33 of 2014 concerning Guarantees for Halal Products. The main problem of this research is how is the Issuance of Halal Certification by the Halal Product Guarantee Agency (BPJPH) in Pekanbaru City Based on Law Number 33 of 2014 concerning Halal Product Assurance? and What are the Obstacles in Issuing Halal Certification by the Halal Product Guarantee Organizing Agency BPJPH) in Pekanbaru City Based on Law Number 33 of 2014 concerning Guarantees for Halal Products The research method used in this study is to use empirical legal research with data collection techniques, namely observation interviews. Judging from the nature of this research, it is a descriptive research, namely research that provides a clear and detailed description of the main research issues. The results of the discussion of this research are Issuance of Halal Certification by the Halal Product Assurance Organizing Agency (BPJPH) in Pekanbaru City Based on Law Number 33 of 2014 concerning Halal Product Guarantees in Pekanbaru in the implementation of halal product guarantees for business actors according to Article 4 of the Law Number 33 of 2014 concerning Guaranteed Halal Products which states that products that enter, circulate and trade in the territory of Indonesia must be halal certified. This decree has the implication that all or every product (food, drink, medicine and cosmetics) that enters, circulates, and is traded in the territory of Indonesia must be halal certified. Law Number 33 of 2014 concerning Guarantees for Halal Products also emphasizes that MUI continues to carry out duties in the field of halal certification until BPJPH is formed. Furthermore, in Article 64 it is stated that BPJPH must be established no later than 3 (three) years from the promulgation of this Law and the Inhibiting Factors in the Issuance of Halal Certification by the Halal Product Assurance Organizing Body (BPJPH) in Pekanbaru City Experts: Until now the lack of experts has certainly become MUI's obstacles in carrying out its duties in guaranteeing halal products, because the hope is that LPPOM MUI will be formed as a way to use science / science as material for consideration in making a halal fatwa or not a product.
