Abstract

This study has the objective of knowing the registration of rights to fiduciary guarantee objects that are not registered, this will result in no obtaining of fiduciary guarantee certificates. Then this research also determines the legitimacy of the execution of the unregistered fiduciary guarantee object which should really need legal protection from various parties. If it is not registered, it will be detrimental to that party. Basically this type of research is normative legal research with the nature of descriptive research, which describes the nature of individuals to determine relationships with one another. The data source is primary data presented in the form of various regulations, then there is secondary data in addition to previous arguments through books, journals and other scientific works and finally there is tertiary data in the form of dictionaries and encyclopedias. The results of the study state that the registration of fiduciary guarantees must be registered at the Fiduciary Registration Office which is then issued a fiduciary guarantee certificate based on "FOR JUSTICE BASED ON THE ONE ALMIGHTY GOD". If there is a change in the certificate, we are obliged to submit an application for registration of the change at the Fiduciary Registration Office and reissue a statement of change on the certificate itself. Regarding the validity of the execution, it is regulated in article 29 of Law Number 42 of 1999 concerning the Execution of Fiduciary Guarantees. Where the birth of a statement deed must have the approval of the fiduciary giver.
