Abstract

Regarding divorce between husband and wife, there are often struggles for child custody. Regarding custody, there are children who follow their mothers but their children are taken care of and cared for by their grandmothers and grandfathers every day. There are also those who follow their father but are then not noticed by their father because their father has remarried. For children who follow their mothers, they tend not to be allowed to meet their fathers. In the case of child custody that falls to the father, there is often neglect of the child. This is because the father then remarries and only focuses on his new family, especially if in his new marriage the father has another child with his new wife. Children from previous marriages are ignored and not considered for growth even though the child follows his father based on the results of court decisions. In the thesis entitled "Divorce and Its Effects on Post-Divorce Child Custody According to Law Number 35 of 2014 concerning Child Protection in the Dumai Religious Court in 2020", the focus of the study was to determine Post-Divorce Child Custody According to Law Number 35 of 2014 concerning Child Protection in the Dumai Religious Court in 2020 and to find out the Effect of Divorce on Children Due to Divorce in the Dumai Religious Court in 2020. The method used to answer the problems mentioned above is to use a combined research method, namely normative legal research methods and empirical legal research methods, namely by conducting literature studies and collecting data by conducting interviews. Based on the results of the study, it is known that respondents from the mother and father side are responsible for child custody. But both revealed that they find it quite difficult to divide their time between work and childcare. So that both this mother and father leave their children in their family home while they work, and some let their children live in the residence of their parents who are their grandparents for the reason that they are fulfilled love for their children while they are busy working. Divorce has a huge influence on the mental development and education of children, especially elementary school age children and adolescents. Among them can cause children to be quiet and inferior, excessive naughty, low learning achievement and feel lost. In addition, the effect of divorce on children in Dumai City is mostly caused by the divorce of both parents.
