Abstract

Land has an important role in human life related to the contents of the 1954 Constitution Article 33 Paragraph 3, the importance of managing land rights Land problems usually arise in communities that tend to lack access to land and protection of community rights due to unmanaged land use, the discussion about land is regulated in Law No. 5 of 1960 but there are many problems related to land as happened to residents in Kesuma Village. The main problem in this study is about the granting of land rights and the factors that occur to the people of Kesuma Village, Pangkalan Kuras District, cannot get land rights in the Teso Nilo National Park area. This study uses a type of sociological legal research and is descriptive analysis with the chosen location, namely Kesuma Village Kecaman Pangakalan Kuras, researchers conducted interviews with Kesuma Village Head Yasir Hermawansyah Sitorus, Head of Field Evaluation (Evlap) Teso Nilo National Park Office Dodi Firmasyah. S.Hut, Head of the Land Registration Office of Pelalawan Suparyadi Regency, and distributed questionnaires to the people of Kesuma Village. The results showed that granting land rights to communities could not be done due to several factors because the area or area they lived in was included in the National Park or state forest, conservation area first before the community registered land for the area.
