Abstract

The application of Restorative Justice by means of Diversion which is applied by Rokan Hulu police investigators in dealing with every child problem, especially this traffic crime case, so in the opinion of the author, all criminal acts where the perpetrators are children, not all can be diverted, so the case continues. until the trial stage at the Rokan Hulu District Court. This of course will have a serious impact on the child's future, because after all the child should not be sentenced to prison, but due to the failure of this diversion process, the child must take a case in court and when the judge decides on a criminal sentence against the child, it is certain that the The child already has a history of criminal records. Based on the background above, the formulation of the problem that will be answered in writing this thesis includes: How is the Settlement of Traffic Accident Crimes with Diversion Against Children as Actors in the Legal Area of the Rokan Hulu Police? And what are the factors causing the failure of the Completion of Traffic Accident Crimes with Diversion Against Children as Actors in the Legal Area of the Rokan Hulu Police? This research, when viewed from the type of research, can be grouped into Sociological Law research which is carried out by survey method, namely research directly to the research location using data collection tools in the form of interviews and questionnaires. Meanwhile, if seen from its nature, this writing is descriptive analytical, which means that the research is intended to provide a detailed, clear and systematic description of the main research problems. Completion of Traffic Accident Crimes with Diversion Against Children as Actors in the Legal Area of the Rokan Hulu Police that investigators must consider the category of crime committed, the age of the child, the results of community research from the Bapas, and support from the family and community environment so that in resolving the problem of criminal acts Traffic crimes where the perpetrators are children can be realized through diversion efforts as mandated by Law no. 11 of 2012 concerning the Juvenile Criminal Justice System which aims to achieve peace between victims and children, by resolving child cases outside the judicial process, thereby preventing children from being deprived of liberty, encouraging the community to participate and instilling a sense of responsibility towards children.
